What Employers Need to Know

On March 12th, President Biden signed the American Rescue Plan Act (ARPA), a law that mandates significant new changes affecting employer benefit plan obligations. Specifically, ARPA includes a complex set of COBRA subsidy rules that will require employers to review and assess which COBRA beneficiaries are eligible for subsidies. In addition, the subsidy contains repayment requirements and penalties if mistakes occur, or when the program is misused.

Our webinar surveys COBRA subsidy responsibilities and organizes them into manageable and actionable component parts. This program is intended for employers and benefit plan administrators and will cover:

  • New operational and notice obligations;
  • Assessing COBRA eligibility as far back as November 2019;
  • Subsidy eligibility and interaction with "emergency outbreak" period rules;
  • Employer tax credits to recoup costs relating to the subsidy;
  • Subsidy duration and termination events; and
  • Practical employer considerations on what to do next.

*Please note that with ARPA’s enactment, Congress directed federal regulators to publish implementing rules that will become available soon. HUB clients and prospective clients, however, are asking urgent questions about what has occurred to date. We also believe that reviewing the new law’s statutory framework, in conjunction with guidance issued for the original 2009 ARRA subsidy, offers employers meaningful insight about what to expect and the considerations that will factor in developing a compliant subsidy program. HUB International also plans a follow-up program after official implementing regulations and model forms are released.
