2020 CPR LATIN AMERICA CONFERENCE

NOW ACCEPTING NOMINATIONS FOR CPR DIVERSITY AWARD

In 2007, the National Task Force on Diversity in ADR created an Award for Outstanding Contribution to Diversity in ADR recognizing a significant contribution to diversity in the alternative dispute resolution field by a person or organization. Submissions are reviewed by a panel consisting of past winners, along with CPR’s Co-Chairs of the National Task Force on Diversity and CPR’s President.

Users expect the arbitration process to be both fair and efficient in terms of time and costs. In that regard, as put by one of my learned Swiss colleagues, Dr. Berger, from the parties’ perspective: You know the arguments and motions put forward in the proceedings, which is the input; You can see the result in the form of the dispositive section of the award, which is the output; and you can try to understand the reasons given for the decision in the award, which will be the transfer element.

SUPREME COURT REJECTS AN INTERNATIONAL ARBITRATION CASE

The U.S. Supreme Court this morning declined to hear the international arbitration case of Big Port Service DMCC v. China Shipping Container Lines, No. 20-128.

The issue in the case was the standard for issuing an injunction related to arbitration–specifically, “Whether the U.S. Court of Appeals for the 2nd Circuit erred in recognizing a cause of action for a party seeking to avoid arbitration and in concluding that courts have remedial power — untethered to any federal statute and unconstrained by the Supreme Court’s precedents governing the grant of injunctive relief — to issue injunctions against arbitration.”
